UP News: Divisional Commissioner and Commissioner will hear appeals in cases of Goonda Act, amendment done A to Z Counsel

In Uttar Pradesh, appeals in cases of Goondas Act will be heard by the Divisional Commissioner and the Police Commissioner. After the commissionerate system was implemented in four cities of the state, it was partially amended two years ago. However, to end the contradiction in Section-6 of the Bill, the Government of India had asked to make a clear proposal to remove the Commissioner of Police from Section-2 of the Bill and give original power to JCP, DCP.

After which the cabinet has approved the proposal to withdraw the UP Gunda Control Amendment Bill 2021 from the Government of India and bring a new amendment bill in its place.

Actually, there was a contradiction regarding the appellate authority in the bill sent earlier. In the commissionerate system, from the police commissioner to the DCP, the authority was given to impose the Goonda Act, while the divisional commissioner was made the appellate authority. This was causing practical problems. In view of this, by making a new amendment in the bill, the police commissioner has also been made an appellate authority.

JCP, ADCP and DCP have been empowered to enforce the Goonda Act. On the other hand, in districts where there is no commissionerate system, the DM and ADM will be able to impose the Goonda Act as before, while the appellate officer will be the divisional commissioner.
