The Allahabad High Court has refused to interfere in the order of Special Court Prayagraj rejecting the discharge application of Bahubali Umakant Yadav on the police charge sheet in the criminal case registered in Line Bazar, Jaunpur. Justice DK Singh has given this order while dismissing the criminal revision petition of Umakant Yadav.
The court said that at the time of hearing for framing of charge or acquittal, the court will see whether the evidence collected during the investigation has prima facie made out the crime or not. The petitioner said that as a public servant, before filing the charge sheet, permission should have been taken from the government to prosecute. The court cannot take cognizance of the charge sheet. That’s why the case cannot go against him.
The High Court court said, this argument was not given in the special court. raised for the first time. Can be raised at the appropriate time during the trial. Right now the issue is premature. The court said that the special court has not violated any law in rejecting the application.
