Even though there is uncertainty regarding Municipal Elections, a Public Interest Litigation was filed in the High Court on behalf of Mrinal Chakraborty objecting to the inclusion of NIT in the area during the creation of the Division in Municipal Elections. After hearing this, Justice Atul Chandurkar and Justice M.W. Advising the petitioner to do more research on this issue, Chandwani adjourned the hearing for two weeks.
Chakraborty himself on behalf of the petitioner and Adhikari on behalf of Municipal Corporation. Jaimini Kasat advocated. The petitioner believed that there are 2 agencies of development in the city. Whose own scope is fixed. If the range is fixed, then only the settlements that come under the purview of the Municipal Corporation should be included in the division during the municipal elections.
Can’t do development in trust area
The petitioner was of the opinion that development work is done by the Municipal Corporation in its area and by the Trust in its area. Even in the area of trust, it is not possible to do development work with the Local Development Fund of Municipal Corporation. If Municipal Corporation cannot develop in these areas, then people of these areas should not be included in the division only for votes. During the formation of the trust itself, the jurisdiction of the trust has been identified for development works, due to which the area of both the agencies has been determined separately.
Manpa engaged in digging the notification
During the hearing on the petition, no notice was issued by the High Court, but a request was made to the Municipal Corporation’s lawyer to help the petitioner in this matter. Even as the petition has not been dismissed, now the Municipal Corporation has to present proper information before the High Court, due to which the Municipal Corporation has started investigating the notification issued by marking the area while fixing the scope of the Municipal Corporation. Municipal Corporation believes that Pranyas is only a planning authority whereas Municipal Corporation is a civic agency through which basic facilities are provided to the people. The scope of Municipal Corporation is also certain now. Only a small part of the trust has plans as the planning authority.
