The Allahabad High Court has reserved its decision after the arguments of the parties on the legality of cancellation of candidature for the post of Assistant Prosecution Officer (APO) despite having applied with the disclosure of criminal case. It was said on behalf of the government that the acquittal was ordered on the second day after the cancellation of the candidature, but the petitioner was not acquitted in a respectable manner. While the petitioner says that he disclosed the crime and has also been acquitted.

It is wrong to cancel his candidature after being selected. This order has been given by the division bench of Justice SP Kesarwani and Justice MAH Idrisi on the special appeal of Lalit Kumar, Additional Divisional Clerk in the Office of the Director General of Meteorology, Ministry of Geology, Government of India.

The petitioner applied in Assistant Prosecution Officer Recruitment 2015. On 21 August 2017, he was selected by the UP Public Service Commission after being successful in the examination and interview. Later, the court also acquitted him in the criminal case on February 1, 2019. The application filed in demand of appointment was rejected on November 6, 2021 saying that honor has not been acquitted. The single bench dismissed the petition, which was challenged in appeal.
