The Allahabad High Court rejected the petition of Afzal Ansari, brother of Mafia Mukhtar and Member of Parliament from Ghazipur, seeking a stay on the hearing of the ongoing gangster case against him in Ghazipur District Court.

MP Afzal challenged the dismissal application on August 4, 2022 and the order of framing of charges against him on September 23, 2022 by the Special Judge MP / MLA Court of Ghazipur. Dismissing the petition, the High Court ruled that even if an accused is acquitted in a gang chart case, he can still be punished under the Gangster Act.

Justice DK Singh has given this order while rejecting the application filed by MP Afzal Ansari under section 482 of the Code of Criminal Procedure. Arguing on behalf of the petitioner, senior advocate Dilip Gupta said that an FIR was lodged against the petitioner under the Gangster Act in the year 2007 regarding the FIR lodged against the petitioner in the murder case of BJP MLA Krishnanand Rai in the year 2005.
