The Allahabad High Court has acquitted two accused lodged in jail in the murder case that took place ten years ago. The court has observed that there are contradictions in the statements of the witnesses. Witnesses two and three ceased to be eyewitnesses to the incident. The Sessions Court did not examine the statements of witnesses two and three properly. Therefore, the links of facts and circumstances do not intertwine.

The court acquitted both the accused and ordered their release from jail. This order has been given by Justice Dr. Kaushal Jayendra Thakar and Justice Ajay Tyagi while hearing the criminal appeals of Rajneesh and Vijay Pal.

In the case, the plaintiff Sue Anek Pal had lodged an FIR against Vijay Pal and Rajneesh and other accused in the Rajpura police station of Sambhal district for the murder of brother Gauri Shankar. In the case, the sessions court of Badaun district had convicted him and imposed life imprisonment and a fine of Rs 10,000. Vijay Pal was also sentenced under the Arms Act. A total of nine witnesses were presented by the prosecution.

The court, while hearing the case, found that the charges against both the accused were not proved. The court said that the testimony of witnesses two and three cannot be relied upon. Because he was not an eyewitness. There is a contradiction in his testimony, so that the crime is not proved.
