New Delhi: If the former Chief Justice of India B.K. N. Kripal’s son and senior advocate Saurabh Kripal (Saurabh Kripal) is approved by the re-sent recommendation of the collegium for appointment, then he can be the first gay judge of any constitutional court of the country. The top court had decriminalized consensual sex between two same-sex adults. Kripal studied law at the University of Oxford and did his Master of Laws (LLM) at the University of Cambridge before returning to India after a brief stint at the United Nations in Geneva. He has been practicing in the Supreme Court and the Delhi High Court for more than two decades.
Kripal has also edited a book “Sex and the Supreme Court: How the Law is Upholding the Dignity of the Indian Citizen”, which attempts to explain and explore the law’s impact on various aspects of sex, sexuality and gender. has been done. He was recommended for elevation by the Delhi High Court Collegium in 2017. The high court collegium was headed by Acting Chief Justice Gita Mittal. Regarding the objections, the Collegium said that RAW’s letters have not drawn attention to any such apprehension regarding the personal conduct or behavior of Kirpal’s accomplice, which has a bearing on national security. Regarding the second objection, the Collegium said it needs to be noted that the Constitution Bench judgments of the Supreme Court have clarified that every person is entitled to maintain his/her dignity and individuality on the basis of sexual orientation.
