Nagpur. Challenging the show cause notice issued for the cancellation of the license of the cheap grain shop, the Government Healthy Grain Dealers Association filed a petition in the High Court. After hearing the petition, Justice MS Jawalkar and Justice Vrushali Joshi issued notices to the Secretary, Ministry of Cooperation and Marketing and others and ordered them to file a reply within three weeks. On behalf of the petitioner AM Ghare and Assistant Public Prosecutor SS Jachak argued on behalf of the government.

During the hearing, the counsel for the petitioner said that under APMC Rules 6(4) dated September 16, 2022, APMC has no right to cancel the license in this manner. Even she cannot issue show cause notice. Despite this, a notice has been issued as to why the license should not be cancelled.

During the hearing, the lawyer appearing for the government said that the APMC has only issued a show cause notice. So far no action has been taken in this regard. The petitioners have only to file a reply. Therefore, it is not tenable to file the petition before taking action.

Opposing the arguments of the government, the counsel for the petitioner said that the issue of show cause notice is a kind of illegal action. It is not according to the rules. After the arguments of both the sides, the court said in the order that due to the date being mentioned in the show cause notice, now this proceedings can be continued, but the court also ordered not to take further action till further orders.
