After the intervention of the Allahabad High Court, CEO New Okhla Industrial Development Authority, Gautam Budh Nagar withdrew the illegal and arbitrary recovery notice saying, nothing is due on the petitioner. Noida had issued a recovery notice of Rs 1 crore 15 lakh 32 thousand 469 against businessman Ravi Kumar Bansal for the outstanding installment of the allotted industrial shed in B.27A Sector 1.

However, the civil court has already given a decision to deposit the entire allotment amount and nothing is due. It was ignored. The petitioner gave a representation with the desire to collect the lease rent since 1996, which was twisted and Noida started the recovery process of the outstanding installment.

Court said, due to arbitrary illegal recovery from Noida, the petitioner had to come to the court unnecessarily. For this, the court ordered Noida to pay Rs 50,000 as compensation. Said, it should be paid to the petitioner in a week. This order has been given by the division bench of Justice MK Gupta and Justice Jayant Banerjee while disposing of the petition of Ravi Kumar Bansal. Advocates Abhishek Yadav and RN Yadav argued on the petition.

They said that on the representation of depositing the lease rent, Noida has issued a recovery notice stating the installment due, which was challenged in the petition. Has paid the full installment. When the court asked for a personal affidavit from CEO Noida, it justified the recovery of the outstanding installment. When the court asked about the decision of the civil court, in which the decision has been given to deposit the entire amount, then it accepted the mistake. Said, he will withdraw the order and give a new order. After this, it was told that nothing is due on the petitioner. The recovery notice has been withdrawn. The court has imposed a fine of Rs 50,000 on Noida for harassing by taking illegal action.
