The Allahabad High Court has directed the committee constituted under the chairmanship of District Magistrate Deoria to take a decision within three months regarding payment of compensation to the farmers for the road built in the name of Pulwama terror attack martyr Central Reserve Police Force Constable Vijay Maurya. The court has quashed the October 3, 2022 order refusing to pay compensation for the agricultural land acquired by the committee for the road being built. The road is being constructed by the Public Works Department by widening Chakrod from Hatwa bypass in Bhatni block to Chhapia Jaidev village via Jigna Mishra village. But the compensation has not been given. On which this petition has been filed.
This order has been given by the division bench of Justice MC Tripathi and Justice VK Singh on the petition of Pawan Kumar Mishra. Advocate Nitesh Kumar Srivastava argued the petition. They said that 1.8 km road is being constructed. In which their farming land has been acquired. One and a half feet footpath and drain are also being constructed on the side of 3.75 meter wide road.
On the complaint of the people of Jigna Mishra village, the District Magistrate constituted a seven-member committee. It submitted its report and the claim of the petitioners seeking compensation was rejected. He says that Chakrod is being made in the form of a road. But the petitioner says that his agricultural land has also been consumed in the construction of the road. The claim has been rejected on the wrong report of the Executive Engineer PWD. The court said that the claim is based on facts, which cannot be settled in the petition, so the committee, after listening to the petition, take a decision as per the mandate.
