High Court: Explanation summoned from the government advocate for not preparing the case file burnt by fire even after three months

The Allahabad High Court has expressed its displeasure over the non-compliance of the order to reconstruct the file after a lapse of three months due to the fire in Ambedkar Bhavan, Advocate General’s Office and has directed the government advocate to comply with the order given on July 28, 2022. The court has said that being the head of the office, it is the responsibility of the government advocate to get the court orders obeyed. The court had ordered the case file to be prepared, but the Government Advocate did not make any effort to prepare the file. Didn’t even ask for the information of the case.

The court has sought a written explanation from the government advocate as to why the court order was not followed even after three months. The application will be heard on December 2. Justice Manju Rani Chauhan has given this order while hearing the bail application of Upendra.

In July 2022, the court had ordered the petitioner advocate to hand over the copy of the file to the government advocate’s office due to the fire in the Advocate General’s office, which got burnt. The hearing was postponed. When the case was filed after three months, there was no official file. On which the court has directed the government advocate to follow the order.
