Former BSP MP Kapil Muni Karwariya has got a big relief from the Allahabad High Court. The High Court has quashed the criminal case against him in the court of CJM Kaushambi on charges of illegal mining, terming it as illegal. The court has said that FIR cannot be lodged against the Mines and Mineral Act and Rules. Complaint can be filed as per rules. The court, while canceling the criminal case on the police charge sheet, has given the state government the freedom to set up a complaint case.
Justice DK Singh has given this order while accepting the petition of Kapil Muni Karwariya. The argument of the petitioner was that the police do not have the legal right to investigate by registering an FIR in the case of illegal mining. Complaint can be made in the department. The court had sought response from the state government on this legal aspect. The contention of the petitioner in the counter affidavit was accepted as correct. On which the court has canceled the criminal case.
