The tender process was started on 15 November 2022 with special conditions for the appointment of new employees as computer managers in place of the old computer operators working in Municipal Corporation. Even on November 21, 2022, the correction letter was issued again with some improvements in it. A petition was filed in the High Court on behalf of Jayant Kulkarni and others requesting to declare the process of this tender as illegal. After hearing the petition, Justice Atul Chandurkar and Justice Anil Pansare issued notices to the State Government’s Urban Development Department, Municipal Commissioner and Assistant Commissioner and ordered them to file a reply, while refusing to stay the tender process for the time being. The petitioners requested the Municipal Corporation to order the petitioners to be made permanent in regular services on the posts they are currently working and to pay salaries as per the recommendations of the Minimum Wage Commission. It was told on behalf of the petitioners that since the year 1998, he is working in Municipal Corporation as a computer operator. Now suddenly the Municipal Corporation has started the tender process for the appointment of computer managers as computer operators in various departments. After starting the tender process, on 21 November 2022, a sudden decision was taken to change the terms and conditions. According to these terms and conditions, it has been decided to deprive the services of currently working computer operators.
Government fixed minimum wage
On behalf of the petitioner, it was told that a notification was issued by the State Government’s Industry, Energy and Labor Department on 24 February 2015, in which the minimum wage of skilled labor was determined. The petitioners also come under the category of skilled labor according to the rules, while now it has been decided to appoint computer operators according to the tender issued by the Municipal Corporation and pay according to the minimum wages prescribed in the Shop Establishment Act. On November 3, 2022, an appeal has been filed with the Urban Development Minister against this functioning of Municipal Corporation. A decision has not yet been taken on the appeal. Therefore, a request was also made to order a stay on the process of Municipal Corporation.
