The Allahabad High Court has canceled the suspension of eight policemen engaged in security duty in connection with the unrestrained statement made by mafia Vijay Mishra against the ADG Law and Order of the state and others during the production from Agra to Mirzapur court on August 5. The High Court has termed the suspension of the policemen on the charges as surprising without holding a departmental inquiry.

In the case, SP Mirzapur had suspended all eight policemen, including the Police Inspector, on August 5, 2022 under the provisions of Rule 17(1) of the Uttar Pradesh Subordinate Category Police Officers (Punishment and Appeal Rules) 1991. Simultaneously, all the suspended policemen were attached to the police line Mirzapur. This order was passed by Justice Rajesh Singh Chauhan while allowing the petition of Police Inspector Abhay Narayan Tiwari and other policemen.

Senior advocate Vijay Gautam and associate advocate Atipriya Gautam, appearing for all these policemen, argued that while passing the suspension order, there should be sufficient evidence against the policemen for suspension. It was said that the officer did not have any such evidence or facts on the basis of which the suspension of eight policemen could be done.

The counsel argued that the suspension order was passed in a hurry without following the rules and regulations. On August 5, SP Mirzapur suspended all eight policemen and on the same day, ASP Traffic Dr. Arun Kumar Singh was asked to submit a report after conducting a preliminary inquiry within seven days. It was clear from this that there was no evidence at the time of passing the suspension order.

According to the case, there was an allegation against all the eight policemen that the mafia Vijay Mishra had a production on August 5, 2022 at ACJM I Mirzapur. Vijay was brought to Mirzapur under the protection of the Agra Police. But, the police officers posted in the court of Mirzapur were not informed about this. As a result, while returning from the court, video recording of unrestrained rhetoric was made while in police custody on behalf of mafia Vijay Mishra and rhetoric was also made against ADG Law and Order and other leaders of the state.

With this act of mafia Vijay Mishra creating chaos, the law and order situation had worsened. A police inspector, two policemen, two head constables, and three constables posted on the spot regarding the incident were suspended with immediate effect by the SP Mirzapur on charges of negligence, apathy and laxity in the performance of duty, which was challenged in the petition. .
