The order was passed by a division bench of Justice Siddharth Verma and Justice Chandra Kumar Rai on a petition filed by the deceased’s wife Tara Tiwari and two others. Advocate Alok Kumar Yadav, on behalf of the petitioners, said that no employee can be deprived of the benefits of the mandate of 22 June 2021 only on the basis that at the time of death of the employee, he was removed from Kovid-19 and put on a different duty. was.

According to the petition, Tara Tiwari, wife of deceased Ramesh Chandra Tiwari, has filed a petition seeking benefits after the death of her husband due to COVID-19. In the mandate issued on June 22, 2021, there is a condition that the deceased employee was engaged in service related to Kovid-19 at the time of death. Where did it go in the petition that the petitioner’s husband was working on the post of collection Amin in Sadar tehsil of Varanasi district. His duty was engaged in the work of helping people and supplying medicines in Kovid-19. He did this work till 4 October 2020.

The department refused to give compensation to the petitioner on the ground that at the time of death the petitioner was not on duty related to COVID-19.

On this, the court has asked the Uttar Pradesh government to tell the court that the employee who is engaged in the duty of Kovid-19 and later dies after being transferred, then he should get the compensation issued by the government.
