Chhatrapati Sambhajinagar: The Chhatrapati Sambhajinagar bench of the Mumbai High Court today gave a clear order that the development works approved in the budget approved by the Mahavikas Aghadi government but postponed by the Shinde-Fadnavis government should be undone. The order to decide accordingly was given by Chhatrapati Sambhajinagar bench of Mumbai High Court on Friday. This order is confined to the actions of those plaintiffs. Who had filed the writ petition and the said order has brought great relief to Mahavikas Aghadi. While the Shinde-Fadnavis government has suffered a major setback.

The then Mahavikas Aghadi government in the state approved the budget for the year 2021-22 and 2022-23 and gave administrative approval and technical approval. But after the change of power in the state, soon after the Shinde Fadnavis government came into existence, the development works were immediately suspended. The said ban was given to various development works as well as works suggested by public representatives. Due to this ban, all the approved development works in the state have come to a standstill.

Notice issued to the Secretary of Water Conservation Department

People’s representatives of Ambad taluka, Ghansawangi taluka, Jalna taluka and Vasmat taluka of Hingoli district had filed a petition in Chhatrapati Sambhajinagar bench of Bombay High Court against this decision of the government. In which Writ Petition was filed by Advocate Sambhaji Tope by Vasmat MLA Raju Navaghare, former Vice President of Jalna Zilla Parishad Satish Tope, Pooja Kalyan Sapate etc. In this case notice was issued to the Chief Secretary of the State, along with the Secretary of Planning, Rural Development, Tribal, Urban Development, Soil and Water Conservation Department. In that, the court had given transferred orders not to cancel the works already approved earlier.

Proposal should be taken in cabinet meeting

During the hearing, since the development works approved during the Mahavikas Aghadi government were approved in the budget in both the Houses and after the approval of the then Governor, these development works cannot be suspended as per the Constitution. The Supreme Court has also ordered that if any important decision is to be taken or canceled as per the procedures and rules of the government, the cabinet should hold a proper meeting and take a resolution in the cabinet. While suspending the work approved by the then Maha Vikas Aghadi government of the state, without following any kind of legal process, this work was postponed only by issuing an order. That’s why various development works have been put on hold. This type of argument was done by Advocate Tope.

Demand to work according to fund

During the hearing, Advocate Dnyaneshwar Kale, who appeared on behalf of the government, informed about lifting of moratorium on several works. On this, Advocate Tope told the court that the state government has lifted the moratorium on the works of the ruling MLAs. Whereas, the moratorium on the work of public representatives of the opposition parties remains intact. In the petition, a request was made to work according to the funds sanctioned during the period of the Mahavikas Aghadi government. Recently the decision was reserved after the final hearing of the petition. On Friday, while giving an interim order, the court has removed the stay from all the works of the filed petitioner.
