In default of payment of fine, he will have to undergo further imprisonment for 15 days. Along with this, the balance amount of check of five lakh eighty thousand rupees and six percent annual interest on four lakh twenty five thousand rupees will have to be given to the complainant Santosh Kumar within two months from the date of filing the suit. During the trial on behalf of accused Ramakant, Rs 45,000 has been returned to the complainant.

In the plaintiff’s case, the opposition Ramakant Shukla had taken six lakh twenty five thousand rupees on 16 June 2013 and four lakh twenty five thousand rupees on 16 June 2013 for essential work from Santosh Kumar Mishra of Prem Mishra Ka Purva village of Nawabganj area of ​​Prayagraj. The opposition had promised to return the said amount to the complainant in three-four months. But, after the lapse of three-four months, he did not return the amount to the complainant, on 14 September 2013, he gave a check of six lakh twenty five thousand rupees and on 25 October 2013, four lakh twenty five thousand rupees.

The complainant deposited the said check in his bank account but due to insufficient funds in the account of the opposite party, the check bounced. Complainant Santosh Kumar asked the opposition Ramakant to return the money several times, but for not returning the money taken by him, a complaint was submitted in the court under the NI Act. The order was passed after hearing both the sides from the court. Sudip Ranjan Mishra and Lok Nath Mishra jointly advocated the said case on behalf of the complainant.
