New incidents for polygamy 'Halala';  supreme court order


New Delhi : The Supreme Court on Thursday announced setting up of a new five-member event bench to hear petitions challenging polygamy and ‘nikah halala’ or incidental validity of practices in Muslim religion. Advocate Ashwini Upadhyay would have filed a PIL on this or that subject. Justices Indira Banerjee and Hemant Gupta, both of the half-benches, have retired and there is a need for a new bench, Upadhyaya or Chief Justice Dhananjay Chandrachud, Justice. Hima Kohli, Justice. J. B. Pardiwala’s Bench Nidarshanas Anoon Dile. To this, the Chief Justice replied, ‘Let me set up new benches.’

30 August Rosie Ny. Indira Banerjee, Hemant Gupta, Suryakant, MM Sundresh and Sudhanshu Dhulia or the five-judge bench of National Human Rights Commission, National Commission for Women and National Commission for Minorities would have been parties to the public interest litigations and their answers would have been sought in the petitions. After that Ny. Banerjee or 23 September and Ny. Gupta retired on 16 October. Therefore, orders have been given to reconstruct the incident. Polygamy and nikah halala or both the practices should be declared as illegal and incidental, this demand has been made by advocate Ashwini Upadhyay through a petition. Or orders would have been given to set up an incident bench in July 2018 in connection with the petition. Otherwise, the Supreme Court would have issued a Central notice on the petition filed by a woman named Farzana and it would have been clear that Upadhyay’s petition would be heard by the incident bench.
