Historic decision of the Supreme Court, the committee will take the decision on the selection of commissioners of the Election Commission A to Z Counsel

New Delhi : Today the Supreme Court has taken a major decision regarding the appointment of the Election Commission. The issue of the process of appointment of the Chief Election Commissioner has been taken up by the Supreme Court. The appointment of the Chief Director of CBI is done as per the proof. As it comes, the appointment will be done. The court has given orders to set up a committee for the appointment of the Chief Election Commissioner. The committee will consist of the Prime Minister, the Leader of the Opposition in the Lok Sabha and the Chief Justice of the Supreme Court.

A three-member committee will work for the selection of the Chief Election Commissioner. A three-member committee will recommend the President to appoint someone as Chief Election Commissioner. The President gives his approval and then the commissioner will be appointed.

At present there is no leader of the opposition party in the Lok Sabha, but what?

The Supreme Court appointed a three-member committee for the appointment of the Chief Election Commissioner. The Supreme Court will have a committee consisting of the Chief Justice, the Prime Minister and the opposition leader in the Lok Sabha. But, at present there is no opposition leader in the Lok Sabha. Therefore, it is not recommended to include the leader of the largest opposition party in the Lok Sabha.

For the appointment of commissioners in the Election Commission, there should be a collegium-like mechanism or petitions were filed in the Supreme Court for the demand. Or it would have been better to keep the decision on 24 November on the petition. The hearing of the case took place before the bench of Justice KM Joseph, Justice Ajay Rastogi, Justice Aniruddha Bose, Justice Hrishikesh Roy and Justice CT Ravikumar.

Controversy over the election of Arun Goyal

Central government on 19th November 2022 appointed Arun Goyal, an IAS officer of Punjab, as Election Commissioner. Arun Goyal would have retired on 31st December 2022. He would have taken voluntary retirement on 18th November. He would have been made the Election Commissioner on the second day. Prashant Bhushan would have run against it in the Supreme Court.

Uddhav Thackeray also raised various questions regarding the selection of commissioners in the Central Election Commission. Earlier, the Central Election Commission used to recommend only the Prime Minister for the selection of commissioners. Commissioner Election Uddhav Thackeray means or process would have been objectionable. Uddhav Thackeray has welcomed the decision given by the Supreme Court.
