High Court strict: Judge easy target, tendency to make allegations increased, compensation of Rs 10,000 imposed on petitioner

The Allahabad High Court has made serious remarks on the attitude of the people towards the judicial system and while rejecting the transfer application of the petitioner, imposed a compensation of Rs.10,000. The Court observed that today citizens in all walks of life have developed an attitude that a judge is an easy target for them and they can malign the reputation of judges. They can level any charges against them, especially the presiding officers in the subordinate courts are common.

This remark was made by Justice JJ Munir while hearing the appeal of Hari Singh. The court said that such an approach could demoralize the subordinate courts. The court said that such audacity of litigants should be strictly discouraged. At the outset, the court noted that the applicant could not produce the slightest cogent evidence or material to support the allegation in question. In fact, the Court found that the allegations made by the applicant were so absurd that they needed to be dismissed.

In the case, the petitioner Hari Singh is the litigant in the 2013 suit. He filed an application for transfer of appeal arising out of the said suit pending in the Court of Additional District Judge (FTC), Firozabad, to some other court. It is stated on his behalf that the respondent is threatening him that he is in collusion with the Presiding Officer while his appeal is pending. The district judge dismissed his appeal. Thereafter, the petitioner approached the High Court. The High Court rejected his petition and imposed a compensation of Rs 10,000. Ordered to deposit the compensation amount in the account of Firozabad District Legal Services Authority.
