The hearing of the petition against the permission for the worship of Shringar Gauri at Gyanvapi in Varanasi could not be completed even on Friday. Justice JJ Munir is hearing the petition of Anjuman Arrangement Masjid Committee in the Allahabad High Court. Hindu side’s advocates Harishankar Jain and Vishnu Jain said, after the idol’s consecration, that place comes under its ownership. The indirect idol continues to exist even after it is demolished according to Hindu law. The temple was demolished and converted into a mosque, in fact it is not a mosque at all, it is a part of the temple. Because where all the three domes are present, at the time of demolition there were idols of Shringar Gauri, Hanuman and Kriti Vaseshwar Mahadev, which itself was part of the Bhu Bhagwan Vishweshwar Nath temple.

Jain said, under Article 254(2) in the law made by the center and the state, the law of the state will be considered effective in the matter of concurrent list. The Uttar Pradesh Kashi Vishwanath Act passed by the State Legislative Assembly will be effective on the Places of Worship Act. The Kashi Vishwanath Act vests the ownership of the Vishwanath temple on the Gyanvapi premises. The law gives jurisdiction to civil courts for civil rights of worship. The Waqf Board or the Waqf Tribunal has no jurisdiction in this regard. On behalf of the opposition Rakhi Singh, advocate Saurabh Tiwari, referring to the Skanda Purana, said that there is a mention of the temples coming in the Panchkosi Parikrama Marg. There is also a law for his worship.

Shringar Gauri is mentioned to be worshiped only after taking Gyanvapi bath. Presenting a picture of the disputed structure, he said, “From the view it is a temple, on whose wall a dome has been prepared.” The remains of the temple are still intact. Till November 1993, Shringar Gauri was being worshipped, which was stopped by the district administration. In the Purana where the three domes are, there were idols under it. It is part of the temple. There is no mosque there.

Aurangzeb had built three mosques, that too by demolishing temples. Alamgir Masjid is three kilometers away from Gyanvapi. It is not correct to call Gyanvapi Masjid as Alamgir Masjid. There is mention of worship in 11 temples in Parikrama Marg. In which the worship of Shringar Gauri and Kritivaseshwar has been mentioned. After Shringar Gauri, Saubhagya Gauri, then there is a ritual of worshiping Lalita Devi situated at Lalita Ghat. Actually there is no mosque in Gyanvapi. The temple has been demolished and given the shape of a mosque. Deen Mohammad’s lawsuit filed in 1937 allowed his family to offer Namaz, but the premises is owned by Vishwanath, the hearing could not be completed. Senior advocate SFA Naqvi, appearing for the Muslim side, also appeared. The next hearing will be on December 21.
