Bangalore: The Karnataka High Court has set aside the family court’s decision to give call details and mobile location of the third person to the mobile service company in the marriage case of a couple. Due to this, the courts have said that the third person’s right to privacy is violated.

The case between husband and wife went to the court. A third person filed a court petition in the case alleging extramarital affairs. On that Justice M. Nagprasanna got him fired. ‘Husband wants to prove that his wife has illegal relationship. Violating the privacy of a third person just because of this cannot be permitted,’ the Assam Justice said. Since 2018, the case between the couple is going on in the family court of Bangalore.

The Family Court on 28 February 2019 would have given permission to give details of mobile tower records of third persons. Only the third person was not part of the family affair. The third person is the lover of the wife and I want to prove the same thing from the details of his mobile number, otherwise the husband used to say. In 2019, the third person demanded the husband’s demand in the High Court. After this, the High Court stayed the order of the Family Court. The High Court took out the petition on 30 November 2022, Kadhali.

Any citizen has the right to protect the privacy of himself, his family, marriage and other things. Confidentiality related to information is also an integral component of privacy. Therefore, if the details of the mobile tower are kept before the court, the court has concluded that the confidentiality of the information is being violated.
