The Allahabad High Court has ordered the teachers posted on contract in the Department of Microbiology of Chhatrapati Shahu Ji Maharaj University to continue working. Provided that his service is satisfactory and he has not completed the age of retirement. This order has been given by Justice Soumitra Dayal Singh while hearing the petitions of Shilpi Uttam, Dr. Shalini Verma and Dr. Archana Yadav. All three had filed separate petitions. The court passed this order while hearing together.
In this case, appointment letter was issued on 11 March 2011 to the petitioners under Chhatrapati Shahu Ji Maharaj University self-financing course. He was appointed on contract for three years. Since then all the three teachers are teaching as assistant professors. But, the university took out the advertisement for the recruitment of teachers on two different days on 7th August 2021 and 19th August 2021.
Objecting to this, the teachers filed a petition in the Allahabad High Court and demanded the issuance of the order. It was argued on their behalf that the university was trying to illegally terminate their services by recruiting through advertisements. Wants to remove him whereas, the services of the petitioners are satisfactory and he is teaching continuously. Considering the arguments of the petitioners to be correct, the court ordered to maintain the services of the teachers. Said, if his services are satisfactory and he has not completed the age of retirement, he should be retained in service.
