Lakhimpur incident: Police's negligence can bring relief to the culprits, law experts said - action taken without homework

The crime graph is increasing in Uttar Pradesh. The serious negligence of the police is clearly exposed in the case of kidnapping two minor sisters from the house and killing them after raping them in the Nighasan of Lakhimpur Kheri on Wednesday. In this whole case, even the section of gang rape and kidnapping has not been imposed. Law experts believe that there are many such loopholes in police action, which can benefit criminals.

Talking about the police records, the mother of the dead sisters had reached the police at 1.00 pm to get the FIR registered. He had told that along with Chhotu Gautam, three boys entered the house and while assaulting, forcibly dragged both his minor girls and took them to an unknown place on a motorcycle. Special Public Prosecutor Brajesh Pandey says that in such a situation it was necessary for the police to impose a section of kidnapping. The police have not done this. The manner in which it has been said in the statement of the police to reach the accused, it is also seen trying to hide the action.

On Thursday also, several hours after the press conference, the police produced the accused in the civil court. By then the time of the court (at 5.00 pm) had passed. The court of ADJ allowed the hearing on the remand of six accused on the request of the police. The police have imposed sections of the SC-ST Act on all the accused except Chhotu alias Sunil Gautam. Section 201, SC-ST Act has been imposed on Karimuddin and Chhote only for erasing evidence. Sections of rape, murder, POSCO Act have been imposed against the accused Junaid, Suhail, Hafizur Rahman. Police custody remand was not prayed for. All the six accused have been sent to judicial custody till September 29.

Where did Suhail and Hafizur Rahman stay for six hours?

Special Prosecutor Brajesh Pandey says that according to the police, Suhail and Hafizur Rahman were arrested at 7.30 am from Durgapurwa Mor, Palia Road. After this Chhote and Karimuddin were arrested at 8.25 am. Six hours later, Suhail and Hafizur Rahman were admitted to the police station. During this both were said. The police have no answer to this. Chotu alias Sunil Gautam was first brought in the lockup in the records of the police station at 10.15 am. All the other accused were brought to the lockup at 1.15 pm. Whereas the place of arrest is only a short distance away from the police station.

Section of gang rape not imposed

Former ADGC Shailendra Singh Gaur says that in the case of murder after rape of sisters, the police did not impose section 376D of gang rape. In the sections imposed, only one accused was said to have raped. Whereas according to the story of the police, there are more than one accused of raping minor sisters. Because of this, the defense can get relief in court.
