High Court: Clarification sought from Principal Secretary Law on the competence of public prosecutor

The Allahabad High Court has summoned the Principal Secretary Law, expressing displeasure over not providing the information sought from the Government Advocate. The court has also raised questions on the competence of government advocates. Along with this, the date of December 7 has been fixed for the hearing of the case. Justice Manju Rani Chauhan has given this order while hearing the bail application of Satish Kumar of Bijnor.

The court had issued notice to the litigant in the matter asking it to file a reply within four weeks. But, the government advocate could not tell whether the notice has been sent to the plaintiff or not. The court said that requests were made several times to appoint a competent government pleader so that the disputes could be disposed of. Government advocates are also helpless in the matter. He is accompanied by a team of disabled advocates.

The court said, it has already directed the Principal Secretary Home to give an explanation through an affidavit regarding the conduct and inefficiency of the government advocates in the matter of competence of the government advocates. In view of such a situation, on the next hearing of the case, the Principal Secretary, Law, should appear and clarify on the conduct and inefficiency of the Government Advocate.
