The Allahabad High Court expressed displeasure over the postponement of the hearing of the case due to non-availability of the official file. State Chief Secretary Durga Shankar has been summoned and asked how the court should function. Due to non-availability of file in the court, the government lawyers are not able to cooperate with the court and the hearing has to be postponed. In such a situation, the court has no other option but to summon the Chief Secretary.
The hearing of the case has been fixed for December 13. This order was given by a division bench of Chief Justice Rajesh Bindal and Justice JJ Munir on the special appeal of Manish Srivastava and others. In which the government is the opposition party. The court has said that when the hearing of the case started, no one came from the government side.
The court wanted to know who would argue on behalf of the government in this case, so no one stood up because there was no government file in the court. The court said, this is not an isolated case. Due to non-availability of official files of four cases, the hearing had to be postponed. None of the old cases could be heard. On this, the court has directed the Chief Secretary of the state to be present.
