The High Court Bar Association has strongly opposed the proposal of the Collegium to appoint outside lawyers as judges in the Allahabad High Court. Bar Association President RK Ojha said during a conversation with reporters on Saturday that the Bar Association opposes the attempt to make imported lawyers as High Court judges and demands that only lawyers practicing in Allahabad High Court including Lucknow bench should be made High Court judges. .

He also opposed the appointment of retired administrative and judicial officers in various tribunals. Said that qualified lawyers should be appointed under the selection process. With the appointment of retired officers, the tribunals are proving to be white elephants. He can’t do justice. The President and General Secretary of Bar Association of all the High Courts of the country will be discussed and the decision will be taken in consultation with the Bar Associations of the State.

Said that the state government should constitute the UP Revenue Judicial Service cadre. Also, instead of administrative officers, qualified lawyers should be appointed under the selection process. Due to lack of legal knowledge of the administrative officers, the litigants have to wander for justice, they do not get justice. The officers of the Revenue Court are busy in administrative work only, do not sit in the courts.

Said, under Article 217 of the Constitution, only lawyers practicing in the High Courts have been mentioned to be appointed as High Court Judges. For this the consent of the Governor is also taken. How can the state government advise about outside lawyers? When the judges of the collegium did not see the qualifications of outside lawyers, then sending names at the behest of someone is against the intention of the constitution. Outside lawyers are not even aware of the customary procedure of the court including local laws, due to which the lawyers have to face a lot of trouble.

General Secretary SD Singh Jadoun said, among the 17 thousand lawyers of the High Court, what are the qualified advocates who have to be imported. Criticizing the appointment of a Chief Justice from outside the state, he said, being the Chief Justice of the High Court, the problems of the Bar can be easily resolved.

When there are 160 posts of judges, why are names not sent to fill all the posts. At present there are only 100 judges in the High Court. 60 posts are vacant and 16 names have been sent. Out of these, four names are of Supreme Court lawyers, about whom the High Court Collegium has no knowledge, yet they have been considered eligible to be judges. In doing so, qualified lawyers of the High Court have been ignored.

Former president IK Chaturvedi, former general secretary OP Singh, Ashok Kumar Singh, AC Tiwari, CP Upadhyay, Pranesh Tripathi, Ashutosh Tripathi, Manoj Mishra, Neeraj Tripathi, Prashant Singh, Arun Singh etc. were present in the press conference held in the library hall of the Bar Association.

Judicial work affected in High Court due to abstinence from judicial work
