High Court: Order to quash FIR lodged against BJP MP Rita Bahuguna 14 years ago

The Allahabad High Court has given relief to BJP MP Dr Rita Bahuguna Joshi in the FIR lodged 14 years ago. The court quashed the FIR registered against him. This order has been given by the division bench of Justice Sunit Kumar and Justice Syed Vaiz Mian while hearing the petition of Dr. Joshi.

In 2008, the then Tehsildar Vijay Shankar Mishra had lodged an FIR against the MP at the Civil Lines police station. He was accused of misusing his authority as mayor. He along with other accused destroyed the land of plot number 408 located at Fatehpur Bichua. It was argued on behalf of Dr. Rita Bahuguna Joshi that the FIR was motivated by mala fide. The CBI had investigated the matter.

An FIR was lodged in connection with the CBI investigation and after the investigation, a charge sheet was also filed. The name of the petitioner was not mentioned anywhere in that charge sheet and no involvement of her was mentioned. It was said that the petitioner had performed his duties faithfully as mayor and had implemented the decision of the House. No criminal case is made out against the decision of the House. As far as the land dispute is concerned, the Municipal Corporation has only benefited from the decision of the House.
